Mr. and Mrs. Dorsett appeal a summary judgment requiring them to pay the balance of the contract price on a home they purchased from Wesley and Virginia Boardman. They contend summary judgment should not have been granted because (1) genuine issues of material fact exist as to an alleged agreement to withhold $1,000 pending Mr. Boardmans completion of certain construction and an alleged breach of the warranty of habitability; and (2) the court erred in granting prejudgment interest at the rate of 12 percent. The Boardmans counter by contending the appeal should be dismissed because it was filed 1 day late and frivolous; therefore sanctions should be imposed.
